Bank of America home modification program

I like many other contacted Bank of America about the Home Affordability Program and was given the run around for months and finally was contacted by a representative about the program. I supplied some basic information over the phone and was told I would be contacted if I qualified. In June of 2009 I was sent a package requesting financial information to verify my earlier statements which I did immediately.
For the next nine months I was either contacted by phone, letter, and Fed Ex mail for more information, continually stating they had not received the requested documents earlier. I called every time to verify receipt and was told the documents were received. I allowed representatives from Bank of America to drop in unannounced to verify I was living at the address. I allowed an unknown person with documentation that they were a representative from Bank of America, come to my home unannounced to take profit and loss statements from my business for Bank of America. I wrote letters, faxed and phoned trying to speak to my adjuster and was ALWAYS met by a representative that would take the message and tell me they would contact me.
This went on for nine months and finally I received a package saying that my loan would be modified.
Sounds good, doesn't it?
The program works.
WRONG!
Bank of America lowered my interest rate .65% while adding on 9 months of the difference of my trial period payments to my original monthly payment and added it onto my original loan. That's right, if I accept their modification I owe them seven thousand dollars more than my original loan and my monthly payment is just fewer than sixty dollars less. I other words a qualification that was to take up to 45 days and my new payments once accepted would be my trial period payment or slightly higher took nine months for Bank of America to do their job while making seven thousand dollars from a client that was already experiencing financial hardship. The best part is not only is my "new" adjusted payment which is eight hundred dollars more than my trial period payment, it's due in seven days or Bank of America will seek all back money owed and immediately seek foreclosure. Also, this months trial period payment I have been given a grace period of 30 days to send that in. In sixty days I have to send Bank of America two house payments and a trial period payment.
They got me!
This is not how the plan was intended to work. This was not to be another way of Bank of America to make more money. They owe us, remember the bail out?
What can be done? I am at a loss, just having received my acceptance into this great program.
Any help would be greatly appreciated.

I also have been trying to work with BofA for a loan modifacation. Every time they call me and say that I did not send in the paperwork. I have faxed and faxed and fed-exed paperwork into them with no change in the situation. I am also looking to see if I can join a class action lawsuit against them. They continue to loose personal information and tell me that they never recieved it. When you fax documents into them, it does not go to the person working on your account but to someone else the scans them to a computer file that is then trasfered to your accout person. It is this proscess where they are loosing information. They do not scan it as one file but break it into groups like, Bank Statements, Tax Returns and so on. Who evere they have scaning the information in looses some of it during the proscess. This is a planned system of denial. They do not want to help you they just want to keep earning the intrest off of the bail out money.
The entire government needs to be replaced with good men who are willing to get some things strait. I am all for a man earning more than me when he can out work me or out think me in business but not steal from me or the American people. There are laws in this country and these men are no better than some of the gangsters from the early 1900's. They may not be leaving bodies on the ground but they are destroying families and lives through their actions.

I also got the run around from BofA. I lost my job and fell behind on my payments. I received a letter about the HAMP from them, in August 2009, I started the process. In December, I received the paperwork for the trial period. I contacted them, stating that the payments were too high (35%) of my income. They stated that 35% was still in the acceptable limit range. When I asked them how they figured my income, I found that they were including a part time job that I had not had in 6 months (even though I told them when I lost it). They stated that they would refigure and send me new paperwork. This never happened. When I contacted them again in January, they told me that they were not going to refigure the amount, and that I had to sign the trial paperwork or lose my house. I signed and sent back in. After making the payments until August 2010, I received a statement showing that my payments had gone up by over $200 per month. When I called them, they said that they had not had a payment from me since January. I told them that was not possible since they were taken directly out of my bank account. After they looked more into their system, it showed that my money was being placed in another account. I told them I wanted them put into my account. In September 2010, I got a foreclosure notice. I called them, and they stated that they still haven't received my payments since January 2010. That was the last straw for me. Since this was affecting my health, I could not take it anymore. I sent them my keys. Then they called me in March 2011, stating that I needed to make 15 months worth of payments. I told them that they were wrong and that I received a foreclosure letter and sent them my keys. They said that their records showed my foreclosure was on May 4, 2011. I told them, the last letter I received showed that it was in February. I don't know how BofA is allowed to do this. Is there anyone planning a class action suit against them for the way their modification program was run? I am asking them to send me my complete file. When (IF) I get it, I plan on sending it to my representatives in Washington.

I have been working on a modification with BofA for over a year now, they contacted me and said I should qualify, I have sent every document know to man in over and over confirming each time they got it but amazingly they get lost. I have sent in over 800 pages of faxes in the past year only to be told we need this or that...again...or because they have taken so long the old is now expired. I have sent in so many P&L statements its crazy and over 4 years worth of tax statements (my accountant bill is huge). To date still dont have a modification and each month my house is set for foreclosure sale then suddenly at the last second its removed and postponed to the next month as if to a wave a flag in the neighbors face each month about my situation. I was even told I dont live at the house when I met their rep two days before outside when I saw him staring in a kids bedroom window (this is the 3rd guy they sent out btw) Good news is I am getting back on my feet and if I dont get a modification then they can be expect a lawsuit as not only did their previous actions drive our entire economy down the tubes and cost me around 48% of the value on all 8 of my homes but this is the knife in the back and Iam one guy that keeps my word and if it cost me a million in legal fees I will pay the lawyer instead of BofA my house payments and BofA can kindly wipe away my loan to them as payment for this nightmare that seems to have no end and its seems its happening to a lot of people. And also, why cant the different departments at BofA share info? You guys really need to get your act together.

When I think of Brian Moynihan or Barabra Desoer, I think of the song by John Lennon called Piggies:
So if it walks like a piggy, talks like a piggy, by golly it’s a PIGGY!
.

WHERE IS MY LOAN MODIFICATION BANK OF DESTROYING AMERICA!
.
BofA and it’s CEO Brian Moynihan reminds me of that song by John Lennon and George Harrison titled "Piggies" I invite you to listen to this song on youtube and see if it appropriately fits.
.
http://www.youtube.com/watch?v=ovD9rTzs2q4&feature=player_embedded
.
Have you seen the little piggies
Crawling in the dirt
And for all the little piggies
Life is getting worse
Always having dirt to play around in.
.
Have you seen the bigger piggies
In their starched white shirts
You will find the bigger piggies
Stirring up the dirt
Always have clean shirts to play around in.
.
In their ties with all their backing
They don't care what goes on around
In their eyes there's something lacking
What they need's a damn good whacking.
.
Everywhere there's lots of piggies
Living piggy lives
You can see them out for dinner
With their piggy wives
Clutching forks and knives to eat their bacon.
.

When I filed my lawsuit against Bank of America, I thought of the many others out there in the same situation. It was then that we decided to educate the public on what these piggy banks are doing, as well as unite us all together as one voice. Please help me turn this David vs. Goliath modification process, into a Goliath vs. Goliath.
.
Please stand with me and Brookstone Law Firm, and send an email to Bank of Abusing America that states that we will no longer tolerate their potentially illegal, fraudulent, irregular and abusive business methods.

Thanks for writing, we all share the same long, tortuous story and I want to make all the Banksters PAY for what they have put us through. I cannot afford an attorney right now to file suit, but I have had consultations and have been told that you can file, once you are on your feet. My idea is to get all us to file in our local small claims court on the same day or week, it is cheap for us to file and the Banksters will have to provide attorneys for EACH of those cases or lose by default! Usually there is a local magistrate and local juries that are not lawyers and are sympathetic to the consumer who has been abused. The Banksters cannot stop us or prepare, even if they know what day or week it is! Check your local small claims court for the rules and cost and then send a RESPA letter to your loan servicer by certified mail. When you get your response to your RESPA letter and gather your evidence. I will keep you posted on what day we will do our National Political Action, go to every blog you can and post this email and my mail addy, we have to get the word out!
Sincerely
Lo from Texas

i also have a problem with BOA... first they gave me a trial modification... then after that they sent me a letter saying that it would expire such and such date... then many months later, when I finally found a job and reapplied for modification, the representative said i did not qualify and goodbye and good luck. Sad to say the representative sounded very sad about it and all the people who have to answer the phones were very very good... they have to have a job too. But BOA won't help me... I never missed a payment and was always on time, and the fact that they could not spend the time to reprocess the application. President OBAMA, i hope you read these...
And i finally got something in writing from them telling me to pay up or loose my home.

This exact same thing happened to my husband and I. Last Septeber we were offered the MHA trial period. We were experiencing hardship because I was in nursing school and not working. For six months I was told that i was in the trial period and to keep making the payments. Everything was fine. I called twice a week. Spoke to people all over the world and was told the same thing. Appraisers came to my home, several copies of documents were sent.
We were told in March that we did not qualify for the modification. That we were actually declined in Jan. We were told that we had to make up the difference of our trial period payments and then pay regular months mortgage and have it all within three weeks. 5600.00 our our home would go into foreclourse. I was frantic. I had written everyones name and date associated with this offer. I had every piece of mail ever sent to me and sent it all back to them (copies) and still they claimed that it was my word against theirs. They claimed that they notified me of the disqualification back in Jan. They did not.
I drained my savings account of 3000.00 to pay them and made an agreement with the bank to pay over my regular monthly payments to pay off the remainder of the balance. I paid an additional amount in April of a 1000.00. Every month for 5 months i paid two hundred dollars over my regular mortgage. I called them every week regarding our agreement. they stated that this was fine. When checking my balance on the internet I was schocked to see that it stated that our payments were 3 months behind! I called and a representative informed me that I was still actively in the modification trial process for a second look that they take with everyone. None of my money paid since March had been allocated accordingly. it was sitting in a partial bank balance because I didnt have the money in full. I never even gave them consent for that!
I was livid. out of my mind angry. For the entire month of june and july sleezy appraisers came out to my house again to make sure that the property was still "occupied"At the end of July I suggested kindly sueing the bank if the modification was not take off of my account and they told me that I had to send an official letter. What? Ok so I sent a scathing letter telling them to leave me alone.
When they finally took the modification off my account after hounding them for 5 months about it I received another letter stating that once again there was an intent to accerelate on my loan for 1556.00. I had two weekds to pay it or we would loose our home again. They also wanted Septembers mortgage payment as well.
I freaked out again and called for the 400th time and was able to set up a payment program of 1400.00 a month for 5 months until the balance was paid off.
No way.
My husband and I worked overtime for two weeks. I didnt see my children for six days. I paid the 1556.00 in person at the bank. They had no idea how to process this payment for this random charge.
After paying this random charge I paid my september mortgate befor the 16th. I thought I was free.
I called the bank that morning and was graciously reassured that after i make my september mortgage payment I would receive no more suprises. This was it . I was done. I could go back to being a regular home ownere again after a year of headaches and frustration. Yes this is correct.
A day later I received a letter postdated from two weeks previously stating that a payment in August was not received. That once again we are in danger of being intent to accelerate on our loan. [censor].
I am calling a lawyer.
Someone from the bank promised me that he would take this serious issue to heart and fix this seeing that I refused to cooperate on any level ever again.
We have lived in this home for 8 years. my husband, two and seven yr old. I have never missed a payment nor have I been late.
I have to fight for my 1300 square foot 2 story cape cod every day. I am freaking sick of it! I feel like I live in a socialist society. Even know our financial situation has changed now, (we are both employed) we just can not seem to get up because the bank is keeping me down.
Sincerely Erin Bartling

Bank of America cc rip off

Recently, I noticed my Bank of America balance going up, and figured it was just the outrageous interest the bank charges on their credit cards. Upon further review however, I noticed it was not only due to their predatory interest rate, but the due date was changing from month to month, so an additional late fee of $39 was added to my bill. They said it was due to by billing cycle, of course, their motivation was to rip me off. Part of the new credit act, is to assign fixed dates from February of this year. It is a crying shame, it took an act of congress for predators like this bank, to change their ways. Bad word of mouth will also be expensive, and that it my guarantee. If you can avoid this fraudulent bank altogether, then do so!

Bank of America Communication

My Home Mortgage was just sold to BAC Home Loans Servicing, LP this company has no direct website, No Customer service department. Everything is Automated by computer and when called the only real option is to either make a payment or schedule a payment.

This is not the way to do business especially when dealing with someones Mortgage. This company need to be more available, People need to speak to people, not computer. I bet if don't pay my Mortgage someone will call then...I've never spent 45 minutes trying to just get a person on the phone with no success.

Hello fellow "victims" - I use that term lightly but really it seems appropriate? Add my name to this ever growing list of hard-working individuals that are being scammed. I received the letter stating that my home loan was transferred to BAC Home Loans - which as I now see is a big fraud agency. For the past year I have been working with BAC to modify my loan - each time I didn't qualify due to the year my home was purchased, income, etc., etc. etc. I was desperate to save my home so I agreed to a repayment option to bring the mortgage current. The new plan added $200.00 to my $937.00 mortgage payment for 5 months I was so relieved that they were willing to work with me and admit that I agreed to this payment under duress - I have not been able to keep things current with the extra $200.00. I have mixed emotions about finding all of you - it is so validating to hear that other intelligent, hard-working people are in the same situation - HOORAY! But I am peeved and saddened about why we are here? I do have to say that the story about the person with cancer is absolutely heartbreaking and it makes me sick to think about the heartlessness that permeates our country has impacted so many lives. WHAT DO WE DO? I can't afford an attorney - I just completed a Chpt. 7 bankruptcy process so all my $$ went to that?Good luck to all of you - if I win the lottery I will share the $$ with all of you...true story and true promise!

I so agree, we have been trying to get a modification for over a year with BOA and you guessed it just a bunch of bs with them. We have been told so many different things about the status of our modification its unbelievable, how do they get away with this. They have strung this out so long we are now 30, 000 in debt on house payments, just got notified we are not able to get a modification and our home is being auctioned off June 10, 2011. I was diagnosed with breast cancer last year and I thought that was horrible, boa's business tatics are way worse than my cancer. At least with my cancer I might have a chance, but it's not that way with boa. They mislead, misguided, and out right lied to us and now were loosing our home, life and dream as far as I'm concerned. I have four animals, cancer and no where to go after they auction my house, but that doesn't matter as much to me as the way they went about it does. If they had been truthful in the beginning we could have saved this house but they kept telling us your trial period is in the mail and we waited and waited. I started filing complaints with OCC, FTC and anyone else that would listen trying to get some help. No one really listened they just put me off on someone else. So I've finally given up my health can no longer take battling them. I will sign anything to help stop boa from being able to do this to anyone else. I'd go to the white house and stand on the steps for days if I thought it would help. Please let me know of anything that can be done to bring attention to this matter. cbaken5@hotmail.com yes I'm posting my address...

It is so frightening to see how many people are experiencing this nightmare. We have been through the exact same experience. Our last resort was to write to the Office of the Comptroller of the Currency. I would encourage everyone here to write to them. Even though they haven't actually resolved our issue(they are afterall a government agency), our experience with all the rediculous responses from BAC (along with dates, names, times and lists of lost documents) are now on file with a federal agency (specifically designed to monitor national banks) so that if BAC does attempt foreclosure, we have evidence of their incompetence and potentially illegal activity. OCC is charged with monitoring the safe operation of the banking system. Setting people up to have their homes foreclosed on doesn't seem to me in any way to be a safe opertion of the national banking system. This situation must run deep for the government to be allowing the banks to be so reckless with the bailout money they received, even after being sued by so many State's Attorney's General. There is something more dangerous than incompetence and even greed going on here.

It's so funny how all of us America are having so much problems with BofA and yet the president doesn't know any of this. Or does he?!
My husband and I are also going through the same thing for about 2 years already. We have been doing exactly what they wanted us to do, and yet still they say either fax this or apply for Fannie Mae ( we use to be with Making Home Affordable) so we did and now they say they NEVER or have received the papers. Every time we call we get someone diffrent and doesn't have a clue or he/she is telling us something is missing! We just about had it! All this stress and problems. Is it worth it?! Well I think we should ALL send our stories to the news! It's time that President Obama know about all this and solve this problem, because something needs to be done!
We want to sue BofA as well, but we are not sure how to go about it. We need a good lawyer that is willing to fight this with us up to the White House if we must so this wont happen NO MORE!

The same for us. Our BoA loan was not Fannie Mae / Freddie Mac. We pplied for modification "Make My Home Affordable Program" with nothing but inexperienced "call center" telemarketers answering the phone. Excuses like, "didn't receive it, need another copy... I said, " It's a 20 page tax return, can't you just copy the one you have. "Oh no sir, we don't have the capability to do that."
Now, property has just reverted back to lender, as no one bid on it at the Trustee's Sale. Realtor (supposedly a rep for BAC Home Loans Servicing, LP) came the next day and started looking in the windows without even knocking at the door. She left a moveout agreement. Has anyone experience this?

When Countrywide sold our loan to BAC we were just fine with it until they decide to add our escrow and then they call themselves adding our insurance and for the last year and a half ago, I notice that they were charging us for the insurance and called and told them they had never paid our insurance before so where was the money, they told me that the money was sitting in escrow and I could move it over towards a house payment, well I did. But in the meantime we were behind in our mortgage 2 months, so they said to us let’s see if you can get remodified I personally knew it was a bad idea but we said OK like everyone else we have had a decrease in pay because of my husband lay-off. We were decline remodification and then they tell us they were rechecking our information but then when I called they tell me we were getting ready to go into foreclosure so when I asked them how much we owed on the two house payments the guy told us 2481.54 so what I did I borrowed it from my mother and now we are on track but I can tell you this much I would like to go to another mortgage company but our credit score is shot but I will tell you this much I don’t trust this BAC company and the people act as though they cannot tell you anything. OH yes don’t let them draft your payment because they will draft before your do date, this happen to us and we had a shortage on some of our bills. And when I ask them to put our money back they gave us the run around and like I told the man I knew they were full of [censored] and they need to check their people. They really don't care about anyone and they need to quit giving us all this [censored] about how they are here to help us. I know they would love to get their hands on our property but we will give them that right. I hate that Countrywide sold us out to those devils.

I agree and I am having the same problems since my loan was transfer to them from Whilshire last year in March 2010. I had completed the trial payment successfuly and then my loan was transfer to BAC and now I am still waiting on a decision and its March 2011. I have gotten the same run around. My remmodification had been denied or it was denied in error, now we taking a second look, file and appeal or the comments that you were told were wrong. Or they had me in review for making homes affordable and an in-house modification. I did everything I was suppose to do. I was out on medical leave for 6 months and then when I returned to work hours and income was reduced from 40 hours a week to 24-27 hours due to the economic crisis at the end of 2008. Which cause me to get behind along w/ taking care of 3 children, but I was denied b/c of my debt to income ratio. Well what is the program for, of course if someone has a hardship then usually a person ends up w/ more debt than income b/c of loss of income. My am so fed up and I call every month, week and day! There got to be some one that could help us, please. I just needed help getting back on track. I went from owing a lesser before my loan was transfer and for some reason that amount had doubled.

OMG..after reading all of the above comments I am more frustrated than ever. We applied for and were approved a loan from PHFA to make our BAC loan current. Then of course we have to pay them back starting the very next month along with the BAC loan. Has anyone ever tried just getting a mortgage with another bank? Also has anyone ever gotten a statement from BAC with the figures not adding up? I swear out mortgage was just increased and they never told us. Yes we have the escrow included but when you add that figure with teh late charges and the regular monthly payment it does not add up to the figure they have listed that we owe. NO ONE AT BAC can explain this. They are all idiots and I totally agree with everyone's comments. What to do?..Well see what happens when PHFA makes my account with them current at the end of April.

Bank of America increased interest rate/decreased credit limit

Bank of "America"? Please! I have never dealt with a company more UN-American in their overall business philosphy than Bank of "America". Their business motto appears to be screw the consumer every which way they can, take their tax dollars, and ruin credit scores. It is my firm belief that this major corporation has no appreciation or respect for their customers, even those who have perfect credit with the company. I pay my credit card bill on time every month (NEVER late!), have NEVER gone over my credit limit, more often than not pay more than the minimum amount due, and haven't charged anything in many, many months in an effort to get out of debt. Unfortunately they also hold the mortgage on my home as they purchased the original mortgage company my home was financed by. Again, NEVER late on a mortgage payment, and often pay additional towards the balance due. What's my reward for being a good customer with this company for in excess of 10 years? My credit limit on my credit card has been reduced and my interest rate increased for no reason several times in the past couple of years, which in turn raises my debt to available credit ratio, which in turn lowers my credit score, which could subsequently prevent me from obtaining credit elsewhere to pay off my debt with this company. All while Bank of "America" owes "America" billions of dollars and their corporate managers receive sizeable bonuses? Is this their ultimate long-range business plan? Can we say SCAM? As I told an agent with Bank of "America" today, I WILL pay the company every dime I owe them, I WILL attempt to get my home refinanced and pay my hard-earned money to a more deserving financial institute, and once that is accomplished I will NEVER do business with Bank of "America" again. I encourage others to do the same. Let's give this company a taste of their own vile medicine!

As for the recent credit card reform act, well, needless to say it has, from my viewpoint and that of many others I know, done more harm than good. Many of the credit card companies merely got their top weasels together to find ways around the new law, and have done so quiet successfully, all to the detriment of consumers. Hooray for us!

Bank of America escrow account

BOA raised my house payment 36.00 a month due to the escrow increase (property taxes and insurance). This doesn't seem like much to most people, but I live in a small town, so I made a quick trip to the State Farm office & my local tax offices, where I dicovered my taxes went up 100.00 & the insurance 38.00 for this last year. So what does BOA need with the other 250.00 or so? When I called them on it, I was put on hold for 45 minutes and they never came back on! Just think... what if they are doing this to millions of Countrywide account holders! I am in touch with the Attorney Generals Consumer Affairs Office (Wyoming) hoping for some advice and help. Good luck fighting the evil giant!

I had Taylor Bean and Whitaker. You think $36.00 is a lot Bank of America got my loan when TB&W was raided by the feds. The first month our loan was $200.00 more then normal. I called and was told it was a transfer fee. The next month we got a letter stating an increase in our mortgage of $600.00 a month, I called after noting they had put both our summer and winter taxes as $2100. The increase in escrow was still more then the double taxes, but I thought it was s simple mistake. I contacted the city I live in and they informed me my taxes had gone down (because of the extreme decrease in value where I live) $75 a year. I called BoA and they were not helpful. 2 months later my mortgage was increased for a grand total of $2789, my payment was $1200 a month before BoA got ahold of my mortgage. My husband called this time and was told State Farm had not sent them the correct papers and they had given us there home owners, contacted State Farm who had no clue was BoA was talking about. We contacted a lawyer who told us BoA wasn't willing to work with us, they claimed the change was for fees and other things. Least to say we are now having to let our home go. A home we didn't pay more then we should have for, and a home we love. I've heard of many peoples homes being taken after BoA raises there payments so high they cannot afford to pay.

Bank of America fraudulent fees

I have been a bofa customer for 17 years now, with some fraudulent charges on my account that were always quickly resolved when I called. (Wonder how many times other people were charged that maybe didn't notice like I did?)This time was the last straw, though, and I have contacted the Federal Reserve. I recently deposited my income tax return money to my account. A few days later, I transferred some of it to my savings account via online banking, knowing I had overdraft protection in case anything came out of my checking. A few days later, I received 3 overdraft charges! I promptly contacted bofa, and the 3 people I talked to agreed that the charges didn't make sense and would transfer me to the correct call center so this would be fixed. Then I got diconnected and their call centers were closed. So I called back today (3-11-10), and was transferred multiple times before they finally came to the conclusion that they were keeping my $105 worth of fees and that they were right! Really!?!? They say because I transferred it out of my checking account, it was no longer in there, and it hadn't posted to my savings account yet (even though my online banking confirmed that it was), so it was not available there. Where then, may I ask, WAS it? It's MY money, but it's somehow out in "limbo-land" where it's not available to cover my charges? I have been in the wrong before (not had enough money, etc), and I have understood why a fee was charged. But this time, I had plenty of money available, just not "technically" available when I actually needed it. But I am the "little man" and they are the big banking institution, so how do I fight that? This is so frustrating!

I am suffering a lose of $1, 521. 27 phone calls later and a cancelled invitation to consult with my "personal banker" (which I did not know I hired!) I suppose it is wise to use our Government resources which are available to us. The reason: seveal transactions NOT authorized by me were made. Money was taken out of one account- then placed in another account that I hold - and then placed back in the original - and transfers fees were charged to my account! TRANSFERS THAT WERE NOT AUTHORIZED BY ME! - HAD NO PURPOSE - THE OTHER ACCOUNT HELD MORE THEN WHAT WAS BEING TRANSFERRED IN.
THERE WAS NO NEED!AND THEY SAY "PROVE TO US THAT YOU DID NOT CALL THE BANK AND AUTHORIZE THIS"
Why don't they say "we will prove to you that you called and authorized these transactions. Tranactions that make NO sense!

Bank of America merchant services

I will never bank with Bank of America again. I will never use their merchant services and I will encourage everyone I know to find other banks. In all honesty I have felt this way for a long time. Keep in mind, that it’s been middle class, hard working customers like me who have kept B of A in business.

I used B of A merchant services from 7/1/08-1/31/09. I called a week or 2 ahead of handing over my business to a new owner to find out how to close my account etc.
I was instructed to call after business hours the last day to close my account and that my transactions would be processed by midnight of Jan. 31st.

I also encouraged the new owner to use B of A merchant services which I totally regret now. She has had nothing but headaches with their new system.

I received a statement for Feb. where the monthly charges were $38.88. The one transaction left from Jan. 31st was $47.64! Why this was not processed by midnight(1/31/2010), I don’t know, except it’s a great and easy way for the bank to make a few extra bucks on the backs of it’s customers.

Charging me for a whole month for this one ‘left over’ transaction is just wrong and while “legal” is not good customer service or fair in any way.

I called on 3/9/2010 around 4:15pm Pacific time and spoke with 2 women, the second, being Stephanie (ext. 2624) who was supposedly a manager. They both immediately refused to reverse the charges as “it was in the signed contract”. They were both broken records and repeated this at least 4-5 times each. I’m sure they are instructed to do this. I’m sure many people give up
and go away.

After about 10-15 minutes of trying to get some satisfaction, and not giving up, Stephanie finally agreed to reverse the $25 fee, “to end this conversation”. I do appreciate this, however, I still feel that the entire fee of $38.88 should have been reversed except for the fee just for the transaction (which is impossible to really decifer) but which is probably more like 4-6% of the total transaction. I would never have allowed customers to use credit cards on that last day if I would have realized that this was going to happen and that B of A would not consider a better solution without a fight.

I am now an aggravated customer but was fairly happy up to this point with the merchant services customer service. I put up with the fees and processing structure which again, are impossible to figure out and I think way too much for what you actually get. I did this to make it as convenient as possible for my customers. B of A customer service is good when it comes to questions and help and it should be for the prices and fees they are charging. It is not good when it comes to the bottom line – fees. There is no consideration for what is fair or a situation which the bank may be at fault. They have their contract and fair or not, they are not going to budge-even if it means keeping a long term customer.

People are really getting sick and tired of being nickled and dimed to death by big banks like B of A who are paying their executives and ‘higher-up’s’ exhorbitant bonuses, etc. I was just a tiny small business owner struggling like crazy to stay in business and totally over a barrel when dealing with the bank’s processing fees, etc. The system is totally wrong and should be reformed like so many of our institutions in this country.

If B of A would have responded to my reasonable request in the first place which was to reverse the $25 monthly fee, they would have had a very happy customer. Even though the $13.88 is really too much to pay for one $47.64 transaction, I would have let it go. They are actually making more money than I am with this one transaction (they didn't process when they said they would) as it stands.

I will be sending a copy of this letter to the US Attorney General and the Washington State Attorney General. I am sick and tired of the baloney that we as citizens and business people have to put up with to conduct business.

My first home loan was through B of A. I had business and household checking and savings accounts for years. I have an Alaska airlines credit card and will seriously consider cashing in my miles and cancelling it as well. Yes I’m sick of Bank of America. There’s really NOTHING in it for me.

Bank of America I will never do business with them

I applied for a mortgage almost 3 months ago and was locked at 4-3/4% and then when rates jumped recently I received a form letter stating sorry we can't refinance you under this plan! I am amazed at how poor their responses have been. They are the lamest company I have ever dealt with. I will NEVER do business with them and I have done over 7 mortgages with them before!

Bank of America your npv test results

Denied For HAMP Because You Failed NPV Calculations – What is NPV Test?

Where you told that you were denied for the HAMP Loan Modification because you failed the NPV calculator and you are wondering what that means?

If the borrower is not approved for a HAMP modification because the transaction failed the NPV calculations, then the servicer must, explain what the NPV means tell you the factors used to make the NPV decision and advise you that you may request the values used in making the calculations along with the date the process was completed within 30 days of the notice of denial. and dates. The reason they have to provide this information to you is to give you the opportunity to make any necessary corrections to the values they used as they make or break your ability to be considered eligible for the Home Affordable Modification Program.

You or your authorized representative, can request the specific NPV values verbally or by writing to the servicer within 30 calendar days from the notice date and they must answer your request within 10 days.
If you request the NPV values and you have a foreclosure sale pending the servicer must not complete the foreclosure sale until 30 days after they deliver those values to you to give you time to correct the inaccurate values. If there are any.

Bank of America poor customer service

Bank of america keeps sending me unsolicited blank checks! They arrive every 3 weeks or so. I have asked them on the phone to stop sending them, but they keep coming! As a result, I have canceled my account in writing. Bank of america needs to be more receptive to the needs of its customers.

Bank of America Abusive business practices

My brother attempted to refi an existing ARM as a Fixed Rate mortgage through Countrywide. He was told that they could only help him if he was behind in his payments, which he had not been. Per their instructions he naively let himself fall behind. He was then asked to submit the necessary documents and was then told that he would be contacted and not to call them. The next thing that he heard after having pestered them for an answer was that his house would be sold out from under him at a Sheriff's sale. He lost the house and was given 6 months to get out or he would be evicted. My brother was too proud or embarrassed to ask for help and he knew absolutely nothing about such matters. He panicked, went into a deep depression and on 12/16/08 he shot himself in the mouth with a shotgun, two days before the eviction hearing. This was a man with no credit card debt or any other problems in his life. I have since heard from several other people who were told the exact same thing from Countrywide. Does anyone here have a similar story? I am considering joining or starting a class action lawsuit. I look forward to your replies. Thanks in advance.

Bank of America home refinance

My wife and I have excellent credit. Because of the low current rates we found we could go from 11years to 10 years on a mortgage saving us about 38, 000 dollars.
We began this process on Oct. 27th. Hardly ever a word. We occasionally receive an email asking for another current pay stub, or a misc. form. A promise saying that "it should be closing soon".
It is now March 1st and this is just nonsense that it would take a mortgage company this long to do a refi.
After reading so many other complaints, I don't think I want to trust Bank of America to service a loan that they are unable to complete.

OMG Sounds like the same CRAP BofA put us through for over a year. Send this document send that document send the same documents a million times so we can tell you we have it and then request you send it again. We were two months behind when they told me in September that my first trial payment was due in December. They told me I could pay earlier but the first trial payment wasn't due until BEFORE December 1st. So I paid before December 1st then I paid January. Right before I could pay the February trial payment they sent me one of their famous fedex packages stating I was not being modified. About 10 days later we got a fedex letter stating we were in foreclosure. I called and they told me they denied the modification February 10th and then put us in Foreclosure on the 17th. ONE WEEK LATER! They said none of my trial payments would count and I was now about 7 months late. We were 2 months late then they basically told me what to do...and what THEY told me to do made me 7 months late and ultimately put me in Foreclosure...Me, my wife and my 2 year old, my 3 year old and 10 year old. Way to go Bank of America...or should I say Bank of SCREWING America.

In June 2009, My wife and I were interested in the Making Homes Affordable Program offered by BOA---who took over our mortgage from Countrywide, Inc.  We contacted the BOA office in (because:"We're here to help you."), and got the run around on that program, essentially a loan modification program, but were told that we would have to apply for the Special Forbearance Program first.

I am a full-time caretaker for my wife, whose health has deteriorated, and medical bills just kept getting higher, even though we have one of those "Cadillac" health insurance programs.  we also had had major expenses on HVAC failure, so things were about to implode.  we had to do something.

We began the process, provided the required paperwork, and waited to hear further contact.  The representative had our home phone, FAX, and cell phone numbers.  At the end of the month, we had to travel out of state for a few days.  When we returned, we had three messages from BOA (two on the home phone and one on the FAX/answeering machine) asking for more information.  I called back, and was told that we were dropped for failure to respond to requests for further information!  I never got any calls on the cell!

We decided to try it again, and this time we were accepted into the forbearance program.  We were leery to say the least, since the program allows one to "miss" three payments to provide some financial relief---but then one has to pay back those three months of missed payments in a lump sum, not roll the missed payments into the loan, so we were told.  It made no sense, but we did enter the program, hoping to get approved eventually for the Making Homes Affordable Program.

We still made the payments (and on time) under the forbearance program because something just did not add up.  I did some researching  online and found too many horror stories about special forbearance options and how mortgage payments actually increased, and people were forced into quick sales.  Glad I did that.

In November 2009, we received notification that we were approved for the Making Homes Affordable Program----a big $75.00 reduction of our $2000/month mortgage payment!  I was told that the reduction amount could be more after our case was fully reviewed.  We began a four month trial period with a reduced payment.  The trial period ran from November 2009 through February 2010.

In January 2010, we received a FEDEX package requesting more documentation (Well, the same documentation I had already sent at the beginning).  I provided it, and called to insure that it had been received.  I received confirmation that it had been received and that everything was current and up to date, in fact the package was in underwriting.

After making the final trial payment in February 2010, I called to inquire as to the next step.  I was told that everything was in order, all the paperwork was there, and underwriting had the package.  It would take 60 days to finalize, verify occupancy, etc. At that time, i was told to continue making the reduced mortgage payment (Remember, a $75.00 reduction!).  I did continue making the payments and on time.

On 1 March 2010, we verified the status of the package, again.  We were told that the package was complete as of 26 February 2010.  But then, for some reason, we were directed through three other offices, and told that the package was complete, but was "in processing".  To what degree of "in processing" we could not get an answer.  In other words, the right hand did not know what the left was doing.

At the end of March 2010 we received another package.  It was the same type of welcome package I had received back in November 2009.  Essentially, I was beginning the process all over again!  I had to resubmit everything!  I called, questioned why I was being asked to start the process all over, and was told that it probably was a duplicate copy, but to send in the information anyway.  Yes, my package was still in processing.  I sent everything again, even more than was required.  The package was received by BOA on 21 April 2010; I tracked the package.  It was due NLT 24 April 2010.

I called to check on the status on 24 April 2010, and was told that it had been received, was complete, and was being processed.  I was instructed to keep paying the reduced mortgage payment amount.

On May 23, 2010, we received a FEDEX letter from BOA stating that we were not eligible for the Making Homes Affordable Program.  The reason: "Your loan is not eligible for the Making Homes Affordable Program because you did not provide us with the documents we requested.  A notice which listed the specific documents we needed and the time frame required to provide them was sent to you more than 30 days ago.  We may also have sent you additional notices about missing or incomplete documents."

Obviously, they don't have their act together.  There never was a main point of contact for my loan modification, and I always received the excuse, that so many modifications are being processed that sometimes items get lost or sent to the wrong office.

I certainly hope HUD is more competent in handling my complaint against BOA.

Bank of America lies and fraud and worst bank on earth

Over the recent months, I have had several run ins with B/A customer service. When Paypal accidently debited my account and caused overdrafts they would not credit my account. I just got 2 more overdrafts that per posted against pending items. I did not relieze that I was overdrawn and had quickly made a deposit to cover the charges the same day. However, B/A charged me anyway (which according to their reps over the years) was different than what I had been told. Great ... now that overcharge will escalate into a significant sum. B/A has no care whatsoever as to how that impact their customer. I am keeping the account open with a min balance of $10, just to cost them money.

I'm not sure about BAnk of America's policy but I'm 80% sure it's similiar at the bank I work for. Most banks' policies use BAnk of AMerica as a model. We will refund the overdraft fees IF the merchant acknowledges their mistake and posts your refund back into your account via your card or through ACH.

I'd rethink your strategy as far as costing BOA money by leaving $10 in your account. #1: What type of an account do you have with them? If there's a monthly service charge, your defeating your own purpose because you have to maintain a certain balance to avoid the monthly service charge. #2: If you're like me and you were lucky enough to take advantage of their no monthly service charge when you opened their basic account online then you MUST keep the account active. They have the discretion of either charging an inactivity fee if you leave the account dormant. #3: My husband had that idiotic logic too. He wanted to "punish" the credit card companies by not using their card again and forcing them to send paper statements each month. Guess who had to waste time by shredding all the documents? Companies are getting smarter and will find a way to save their costs. The penalty is they raise their fees elsewhere to compensate. Thanks for costing us money, "Likonna".

Bank of America obstruction and delays to getting my savings out

On February 13, 2010 I wanted to make an online electronic funds transfer from my BoA Growth Money Market Savings to my home town bank checking account. Although this feature had long been established and was last used in August, 2009, my bank account was no longer shown an an option. I was told by phone that when an account is not used for a long time it gets "locked" but that I could call a specialist to unlock it. As the account earnings had dropped to 1/4% and electronic funds transfers, normally free, now cost $3 with Bank of America, I told them to close my account. Two weeks later I called again and was told it would take another two weeks to "process" the closing of my account. Finally I requested to talk to a superior and got my home town checking account listed again but -- before I could take my money out I would have to wait 2 weeks to receive a little plastic card costing $19.95, on which they could transmit an authorization code which I then have to enter online, to transfer my funds. This is another safety feature, to make my money secure. (If I had a cell phone with text messenging capability, this card would not be necessary.) So this saga of my trying to withdraw my own funds is continuing.

Bank of America foreclosure???

We received a foreclosure notice in the mail from an attorney. It stated we had defaulted on our loan. It did not make sense. We paid monthly to this company on their website. We had an arrangement to pay a certain amount because they paid our taxes in which I did not want them to. So we were repaying this back. Yes, we were a couple of days late but we still paid it. They informed us that we were 120 days delinquent and I could not figure that out. They also did not do a good job explaining this to us. Pull bank accounts to see when money was sent to them and compare to the Transaction History. We did not miss a month, we are guilty of a one or two days late posting but I just can't see them sending us to foreclosure. Now we have their fees, attorney fees and for what? It is such a rip off during this time of the economy. No one knows what the other departments are doing. It is so frustrating. We made arrangements again and made a large downpayment and we can only pay this bill one way. Shouldn't any payments have at least one grace period. No, we should have made sure it posted on time, however, we did pay this company. We are so confused right now and they aren't any help. Is there anyone we can talk to about this problem. Noone should have to put up with being blindsided by the fine print.

Bank of America home loans customer service

Have you ever wanted to speak to a live person from BAC Home Loans Servicing, LP (Bank Of America)?

Here is how:

1. Dial [protected].
2. Completely disregard all their menus and prompts. Don't waist time typing/saying your loan number, etc. This is all garbage.
3. Ones the initial message is done playing, start pressing 0 (zero). Don't press it too fast, press - let go - press - let go...
4. You're being transfered to a representative.

Maybe more people know about this than I think. I was told that 0 (zero) is usually the default for a representative. However, their menu never mentions option 0 (zero). It keeps asking you about your loan number, the reason you called, etc. without doing anything with the info you enter.

I really hope this helps someone.

EDIT: Now have to enter your loan number. Seems to disconnect you if the loan number is not entered. Otherwise, press zeroes as I said originally.

I am disgusted by the way ya'll have treated me with my making home affordable modification and that you did not lower my house house payments but are now trying to take my home away from me, but yet you will auction my home off for pennies on the dollar instead of working with us and letting us keep it. this is going to stop because if we have to picket bank of america and do whatever else we can do against bank of america we will. call mrs. mccall [protected] CEO of bank of america and let her know to stop doing this to people and also Mrs. ebony brown who told me that either i can accept the modification, forclosure, or quick sale. i asked her to review the modification and she told me that i had those 3 choices only. my husband had to go on disability because he went in for surgery and he thought he'd be back to work in 3 months instead the surgery didnt go well and now he's on permanent disability. if president obama would do what he said he was going to do this would not be happining. “I support John Wright vs. BofA Lawsuit!”

We applied for a loan mod in May of this year and sent in all the paperwork bofa required. We fit into the criteria we owe more then our house is worth my job isn't steady and our house payment is more then 40 percent of our monthly gross income. Well I called weekly for seven months. I always got the run around its in review and then it was in the underwriters hands. I thought it was a timely process, but I felt we were making progress. At one point I was told by a bofa rep that our trial papers were on the way. We had an exact date when they should arrive by. Then came the fed ex letter only to find out we were denied and when I called them to ask why they told me because I was current on my payments, well being current on our payments is a guideline to enter into the program. I was in shock and here is the kicker, before we entered this mod process we paid our taxes and insurance separate, we would charge those so we could have a lower monthly
payment. Well during the process bofa started an escrow account for us and now that we got denied we are stuck with a higher payment then before $300 a month more than our original monthly payment. How is that going to help us. This is a scam and the program would have helped us now instead we might lose our home! buddy012@yahoo.com

Thank you for your postings about the B of A number and the lawsuit...

This was EXACTLY my experience and it took much internet searching to find a correct phone number to call... They will not give you one in customer service and keep directing you to lines that do not exist...

Unfortunately, when you do speak to a representative- they all tell you something that differs from the others and cannot help you AT ALL//////////
I cannot believe they are being paid just to give people the run around and " claim : that they are working on loan modifications and workout programs...

I am mad as hell... and i am not going to take it anymore... to quote the movie network !

Bank of America hugh increase in amount of monthly payment

My home loan was with Countrywide until the big
Bank of America take over. What a mistake that has been.
After a couple of months BOA deciced I didn't have enough
money in my escrow account so they increased my monthly payments $200 so I would have reserve in my escrow account. I asked if they were going to pay me interest on that money and they said no. I said then you don't need it. If Countrywide didn't do it how can you
just decided to do this. I have not been late on a payment and make payments every 2 weeks and its all automatic.
Why with so many families unable to pay their morgages
and Real estate values falling, why would a Bank be allowed to increase payments when an account is not even short and tell me well its in case your insurance or taxes increase in the future. Doesn't BOA already make enough money that they should have to pay customers interest on all escrow accounts. BOA has the rudest employees who are anything but helpful or concerned for their customers.

You are lucky they only raised your morgage $200, they raised mine $900. I started with Countrywide and then been bought out by B of A. They made me impound my taxes and insurance, which I didn't want and then increased my monthly payments. I couldn't afford their raise, so I asked for a loan modification in February and have been fighting them ever since. It is now December and we are still doing the modification plus I couldn't afford the increase of $900/month payments they have put me in foreclosure. And as for rude they are the worst. When they call you with their recorded messages half the time the call gets dropped while your waiting.

Bank of America one the worst service experiences in my ifetime

In process of refinancing my mortgage I was told that I was qualify to do so and 3 days later when I called back to start the process I was not able to contact the original person that I talked to and I was told by another person that I was not qualify to refinance and that the person that talked to me "had no idea what she was talking about". I left massages and emailed the original person and never received a call back. I called back and asked to speak to a supervisor and left massages with him (Matt Ellis) he never called back either. When I called back to talk to someone else the person answering the Phone(Edward painter) after few attempts to get someone on line Hung Up on me. This is the kind of bank that destroys other banks reputation. This was one the worst service experiences in my ifetime.

At my work, the majority of peolpe having the exact problem you describe got their mortgage bought by B of A and the "Hell" as you know is a normal practice with them, Welcome to B of A. The truth is they really don't want to give you a modification and they are going to play the scam, "the left arm doesn't know that the right arm already approved you and you're now in default for paying the new agreed lower payment- because now they want the difference back and your house" But it is too late, you are in foreclosure. It sounds soo corrupt, but they do this tooo often to be a mistake. It's more like a basic unethical practice they adopted. Crummy bank, very sorry. Not many people are sucessful, but I truly hope you are awarded one of the allotted "TOKEN" modifications. Every once in a while they let someone slide through, just so they can claim what a wonderful bank they are with consumers.
