Whom It May Concern:
Yet another reason to not get another account at BoA.
On Friday of last week, I received my refund of my overpayment of my escrow account.
I purchased this home in June of 2011 and told BoA that my taxes would be less than $100, as I am a disabled veteran in the State of [*], and they provide a large discount for property taxes. BoA stated that they wouldn't be able to do anything about it until my tax bill came due, and they had proof of it. No problem, I'm used to corporations feeling that they are superior to everyone, and that no one they deal with has a shred of decency or honesty...particularly bankers, as they tend to spend time around other bankers and see such traits. BoA further stated that they wouldn't send my tax payment to the county until they received the bill.
In October, I received my tax statement (showing I owed $61.00 in taxes...that is not a misprint, it is sixty-one) and dutifully sent it to BoA (expecting them to receive it three days after I sent it...after all, BoA states the same thing about anything THEY send). Apparently, in my ignorance, I didn't send it certified mail. In December, my wife sent an email asking if BoA had received the tax statement, and paid the taxes. BoA claimed they did not receive the statements, but without ANY documentation of any kind, decided to send the full amount in my escrow ($3800+) to the county. They further stated that if I wanted the overage to be returned, I would have to deal with the county.
So, I called the county. They stated that if they received an overage, they would cash the check, apply whatever is required to my tax bill, and then send a letter to BoA asking them what to do with the overage. BoA would then fill out a form, send it back to the County, and request the overage be sent to them. The County would then send the money back to BoA (presumably, BoA would not receive it, but just in case they did), BoA would then eventually issue me a check.
That scenario was entirely unacceptable, so I called BoA, and spoke to a gentleman named [*], who took ownership of the problem. He corrected my tax bill, he corrected my escrow to reflect the correct amount of my taxes, and managed to get the refund check to me on Friday, Dec 23.
So now, I took the check to the local BoA branch. After having to prove my identify through four pieces of ID, my wife and I got the check cashed. Only to be told, that because we don't have a checking account with BoA, we would be charged six dollars. Now six dollars isn't going to break me, but let me point something out to you. BoA has my mortgage of $195, 000 (not by my choice, but BoA bought it from someone else, and presumably felt they could make a profit off of it). The interest rate on the mortgage is five percent. Over the life of the mortgage, BoA will PROFIT nearly $100, 000. Further, we have a credit card with BoA. Its interest rate about 9%. We use that regularly, and rarely pay off the monthly balance. On top of all that, you kept my additional tax payment (of $3800) in escrow for six months...not paying interest to me on it. So here's what's bugging me. You can take the six dollar service fee, and stuff it so far up your ###, that it comes out your throat. You can further be assured, that in the interest of full disclosure, I will contact every person I know, pass by, or can contact through email, telephone, telegraph, carrier pigeon, smoke signal, or hieroglyphics, and let them know my opinion of Bank of America.
untimely notifications & bill pay issues!
I am so upset with this bank. It is becoming a serious issue. No matter how much I try to stand by this bank, it seems to burn me each time. I have been trying to stay steady with my bank account, and trying to be responsible, but to no avail they always pull something. For one, I feel as though with technology the way it is there is no reason why if my account went negative should I get an alert 4 days later alerting me of a fee which I could have avoided had the alert came within a timely fashion (the moment it occurred). I'd rather have too much money in the account and be covered than not enough and be docked! And the FEES were only caused by a late notification, because I cant stay on the website 24/7 monitoring my money...and for the fact that they decided to send out online bill payments by check, instead of immediate withdraw electronically which I prefer. Now all my bills will bounce because of numerous fees being added on, and I can never catch up with my bills because I am constantly paying the bank that is supposed to be making things easier for me. This is ridiculous! The only reason I have not left BOA is because their bill pay has all of my creditors, else I would have already left for my local credit union!
I would like them to address the issue of their notification system being delayed, and perhaps making it notify you of pending and processing fees the moment they occur, and with enough notification to prevent it before the end of business day when we will be charged. I would also like to see a better notification of when bill pay will send out the payment via check vs electronic while I am scheduling my payments. I should be able to choose which I prefer. It is my understanding that electronic transfer puts the power of our money in our hands when our funds are released, and when checks go out it puts the power in the hands of the payees of when they want to cash it, which screws up personal financial planning. And let's face it, its hard to be perfect in this time of economic hardship, and balancing your paycheck is hard when everyone is eating your money. I put my entire paycheck into BOA, and never have any cash on me, when my account hits all of these fees, it puts me and my son at risk with no money till next pay. I have been with BOA for a long time now, I want my money back!
falsely accused of fraud
I receive a letter from a company telling me i won a sweepstake they for $5, 000.00 went to the bank and deposited the teller informed me it was a good check deposit the check i recieved a letter 4 weeks later telling the check was fake that i was reponsible for depositing. as a result of that they put me on checksystem i can even open a bank account anywhere i can even get a job if they backgound check i don't think that fair what they did to me i have 3 kids to support the whole sutuation stress me out much i don't know where to turn.

Bank of America is now our mortgage lender. We didn’t choose them, they bought our loan from another lender that was struggling in the mortgage crash. Since taking over our loan they have demanded several thousand dollars, threatening foreclosure saying we missed one payment over a year ago hoping we wouldn’t be able to present evidence of payment.
Well, we did present the evidence but they ordered us to pay anyway. (6, 500 dollars) about a year and a half they did it again. once again I got the canceled checks to prove they were wrong and I ended up paying another $2500 and then $4500 to resolve the dispute. About two months later they tried again, this time I went to a local Bank of America branch and told them to keep their #%$^N house!
I then had an attorney contact them and it kinda went away (I’m sure they will try again). Now they are refusing to endorse an insurance check to replace our roof that was damaged in a hail storm. They want us to endorse the check and give it to them. I believe that is not only Fraudulent to us, but It might be insurance fraud as well. Bank of America has lied to us on several occasions, misled us on several occasions, and as I said cheated/defrauded us on more than one occasion.
Doing research, I found out Bank of America does this type of fraud to many or all of it’s customers. So much that a mass law suite led by a firm from Georgia is trying. It appears there are many thousands of customers claiming fraud are involved in the law suit. Message here is, “Stay the hell away from this crooked bank/mortgage lender” Unbelievable that a company could operate this way and the government, banking regulators and the legal system in general let this happen. Shame on Bank of America for cheating people.
I agree Bank of America is cheating alot of people. How do we get hooked up the this frim in Georiga. Bank Of America wouldn't help us two years ago then they should have. Said we didn't qualify for a loan modification, now after they foreslosed on us they want to offer us what they should have in 2010. Costing us 144, 000.00. We dont want to sign with them but not sure what happens if we don't take their offer. Even their own attorney said she didn't know why they didn't help us then.

Bank of America is completely un-trust worthy. They want to record the phone conversations but when informed the other party is doing the same. They will not permit it. Why, because they are un-trust worthy!
The fact that they request permission from the party they called; is clear proof of consent to the recording of the conversation, if they claim it is not then under CA law, they have committed an illegal wire tap.
If they record any part of the conversion before all parties give consent again under CA law, they have committed an illegal wire tap.
When the party they called gives consent, all parties have the legal right to record the phone conversation under CA law and US law.
When informed of the recording by all parties Bank of America agents try to make it sound as if the called party is refusing consent.
When forced to admit the truth, the agent’s reply is, “Bank of America does not wish to engage in any recorded conversations”. They end the phone call. You can bet that is not what is written down about the loan account. A record of the truth will not happen with these types of dishonest
Companies, they are such absurd liars.
It is a shame Bank of America can buy up loans without the permission of all parties.
It is time for the public to know the true nature of Bank of America and others like them.

Since you did not take any time to research the any of the laws, then you do not understand it is illegal to record phone conversations for "any reason". It may be done base on consent and depends on location. In one party state any party wishing to record may do so without the consent or knowledge of any other party having said conversion. In a two party state, all parties must give consent. In CA there is an implied consent, where as you are informed of the recording and continued the conversion. Implied also can be if the recording device transmits an audio beep that all parties can hear during the conversion. Now, call across state lines, opps, you are now in the realm of the FED laws. As to the statement you made about editing the recording, try it without leaving a trace, but wait would not all parties have a recording to compare to each other’s.
Just one last question, a simple yes or no.

Do you ever think about the employees that have to take your call from though call center. You call in about a problem do you know they have call time handle to finish that call in 3 minutes or less and solve your problems. If you do not wont to hear the what they tell you then don't used the credit card. Because those employee need to have a job and your complaint get them fired. They are human too so if you call into a call center it is not Bank of America it is a company that maintain your credit card for Bank of America and by they way Bank of America did not take over any companies they just take their company back. You was always dealing with Bank of America.

I have been banking with Bank of America for years. I've had several
checking accounts with them as well as a couple of credit cards (one
personal and one business). I'm in California and am a home loan
officer by trade. Needless to say, the real estate market here has been
in the dumps for the last few years and I haven't made very much money
in the last 3 years. When all my income dried up, I managed to keep
paying all my bills and maintaining excellent credit for 2 years.
Finally in July of last year (2009), I just couldn't keep it up. I had
to stop paying my credit cards. This resulted in Bank of America
charging off the account back around April of this year.
I have
been squeaking by right now on about $700-1100/month. I'm even
collecting food stamps and my daughter and I are currently on Medi-Cal.
So my checking account rarely had more than a few hundred dollars in it
at any one time. I managed to put together a deal that netted me about
$2, 900 and I deposited it into my checking account and immediately used
it to start paying some bills, including my rent for July (I'm behind
right now). I deposited the check on Friday and on Monday there was an
$1, 144 debit in my account! They took everything except the checks that has already cleared and they left me with a
measly $100 in my account! This has caused me an extreme
financial hardship. My rent check was also written against this account
for $860. Now my rent check won't clear and my daughter and I
potentially could be living on the streets!
I
know in England, where our law of setoff descends from, they are not
allowed to take the money to satisfy a "non-priority" unsecured debt if
it causes hardship to the consumer in paying their "priority" bills
such as utilities, mortgage, rent, etc. - basic necessities to live
kind of stuff. Here in the United States though, the BIG Banks can do whatever they want even if it means putting families with children out on the streets!
Change has to start at the top. I don't work for BofA so I don't know for sure but I would imagine that the CEO doesn't take the time to stop and talk to people in the halls or while waiting for the elevator. If hes not doing that then the executives probably aren't either and without leadership setting an example to follow, management isn't talking to their teams and so on and so forth. If you have a company that communicates with one another stricktly in a business manner and the people aren't getting to know one another as people then how could they possibly be getting to know their customers? If they don't know their customers, how could they ever begin to understand them? BofA is laying off 30, 000 employees because they need to trim the fat. Most of these jobs are coming from the branch level. The one place within the company where BofA representatives actually might stand a chance of knowing their customer.
1. Better, more accessable personal finance education programs. (Costs could be absorbed through mktg expense rather than grants and other govt funding)
2. Instead of having the collections department constantly call, demand, and try to trick people into paying debt which they can't afford to do in a lot of cases. Train the collectors in ways to work with those in debt. Some new programs may have to be created by the banks but in the grand scheme of things working with customers to help them pay down debt rather than having to charge off bad debt or have consumers filing bankruptcy is a much better alternative. The key for everyone is working together and communicating. It will be up to the customers to be honest with the bank but the banks are going to have to do a lot more listening and give it a rest with their demands. If I were in a position where I had to choose between paying a credit card or feeding my childeren, I would choose the obvious. Thats the situation for alot of families today with unemployment as high as it is. Things are tough and nobody seems willing to stop and understand anyone elses situation, everyone is concerned with themselves and the banks are all about the bottom line. I understand that they need to make money to stay in business but i'm sure they would do just fine if the money that isn't coming in at all right now started to come in slowly. If the executives have to give up multi-million dollar bonuses then so be it for a year or two. Most of the people that owe debts and can't pay have given up jobs, cars, houses, sometimes even eating meals everyday.
The OP's tone was that they tried to take care of the debt but had so little money coming in that they could barely afford to eat. Ellen, your comment was, In some countries they arrest you for not paying your debt. The tone you decided to take is the same as the BofA jerkoffs. You basically told this person "You don't matter" "Only the money matters". You are entitled to your opinion, you are also entiled to burn in hell. If more people and more companies cared more about people and focused more on being proactive about reaching out to help people then the economy could be repaired sooner rather than later. Debts could get settled before charged off, bailouts wouldn't need to be given, and you people you adopt such a "you created your problem, you fix it attitude" could lighten up and say "my situation is good, lets make yours good too".
I pay a lot of money for my membership to that place. Do you bank with BofA? If so then you pay a lot of money for each of theirs. I think maybe they should go find somewhere else to eat.
Its in very poor taste. I work for a major corporation. I don't blow off steam by trash talking my customers. If you were the head of a major corporation, would you expect people to use your service or buy your product after making fun of them and talking down to them? NO, you wouldn't. If you really liked someone, would you tell them"Your ugly and you smell terrible" and then expect them to say "Yes" when you ask them out? NO, you wouldn't. Pretty much the same thing in my book. So, to your point Ellen. When they decided that it was ok to talk down to their customers and made the decision that even paying customers with great credit were beneath them. They also decided that it was nolonger business and made it very personal. Especially to those of us who have been within earshot of their comments.
Look. I understand what you have all said, but I live in Charlotte. I eat lunch in the city club where the BofA execs eat often. I overhear many conversations and am quite frankly disgusted with what I hear. Those guys laugh about how they screw customers. They make jokes about laying off their employees but still getting to keep their tax breaks they were given for hiring them in the first place. They treat it screwing customers as a game of I'll screw you over and if you don't like it then I'll screw you harder. Shareholders without a ton of shares don't see it, and shareholders with a lot of shares don't care as long as they are continuing to make money.
For the people who intentionally or irresponsibly didn't pay their debts thats true but, for the OP they tried and got behind. The banks have a large part in that with faulty lending practices, corruption, and lets not forget that it was banks like BofA that have alot to do with the economy taking the dowturn that it has and caused people to lose jobs and not be able to pay debts.
Ellen67, you must work for BofA. I'm assuming you aren't one of the ones who lost there job during the recent layoffs. You seem to have no sympathy for the person who posted this complaint. Lets not forget that it was the corrupt dealings of the large banks that screwed up the economy in the first place and caused good people like the kind soul who posted this complaint to lose their higher income. I have no sympathy for the banks who did many wrong things and then got bailed out, then did more wrong and are now srewing their customers as a result. If you sympathise with the banks, you fix them and give them the money they need to get going again and let me know once you've accomplished that. A couple of weeks ago, my husband activated a new credit card. During that call, he was offered the option to transfer a credit card balance at which point he handed the phone to me. I decided based on the information presented to me by Cory Clark that it made sense for us to transfer $5000 to his credit card; however it was not disclosed to me that there was a $200 fee. We intend to pay off the balance before the end of year and had we kept the balance with American Express, we would have incurred lower fees in interest. I would have never agreed to this had I known there was a fee. I even asked if there were fees associated with an early pay off and was told there were no fees associated to the transfer.
I spoke to three different people at BofA tonight and no one is willing to reverse the fee. I have been a customer for 20 years - we have two mortgages with your institution, two savings accounts, two checking accounts one of which is a Prima account, and both of our children have savings accounts. We decided to stand by them during the debit card fee debacle, but I will take my business elsewhere if this fee is not reversed. I feel taken advantage of and deceived and am questioning their business ethics.
account closure with no notification
I have been banking with BOA for over 10 years and have the American Express card by BOA. I usually pay off our card each month because I use it for everything to accumulate points. With no advance warning my credit card was declined and when I called they stated it was closed due to but there was no reason why and i can call the account closure department. I have called and gone into local branches and no one can seem to help me other than directing me to call the account closures department. That department is simply a recording stating they are with other customers and stresses twice at the beginning and at the end that it is the BOA is not required to explain the reason for the closure. So basically they say leave your name and number and we will call you within 24 to 48 hours but it is their policy and they are not required to tell us anything. The worst thing is I have over 160, 000 points that I wAS saving and I cannot even access my points account because the card was closed and was told when I called that the points are usually forfieted when accounts are closed! REALY! I am moving the rest of my account to another bank and so will the rest of my family but I feel like something has to be done about this unfair business practice. Is this what i get for being a loyal customer
I can care less about giving them my business or banking with them. I am talking about them just closing my account so i loose my points which if i transferred would come out to $1500. Where is the consumer protection they can just do that with every customer who has over a certain amount of points and that would make it ok? of course not and I am not the first person this happens to just like the over draft fee which they got sued for and lost $410M looks like they might have another case on their hands soon

We paid the amount of two (2) mortgage payments at the end of December, 2009 to Bank of America who services our Veterans Administration loan. On Dec. 29, 2009, one-half the amount sent was posted as a regular payment with the appropriate amount applied to principle, interest, escrow, and the other half was dumped into our miscellaneous category along with additional funds which now total nearly twos full payment amount. Despite vigorous complaints via email, we cannot get a response regarding our mortgage account.
This misappropriation of our mortgage payments have deprived us of at least the amount of interest which should have been applied to our 1099 Mortgage Interest and included in our 2009 Income Taxes.
We have demanded a written response in the form of an explanation of the above actions but have been denied same.
We want to file complaints with officials of the Bank of America but cannot obtain the names of the officers, i.e., president, chief financial officer, chief auditing officer, mortgage loan manager, customer service manager, etc.

annual enrollment wrong again
My annual enrollment packet for health insurance offered no options. My online acct was the same. I called last Tues and started a service request 2-[protected] phone for enrollment is [protected]. I have called 4 times since then and I have no faith that they even know the problem much less anything being done about it. I had other problems with them last year after Tom's death. I am the domestic partner of a deceased B of A retiree. Since Tom's death the Bank has been horrible to me. I realize they don't much care for things like domestic partnership in Charlotte. But it is law in California.
loan modification nightmare
After 2 Years of my wife & I applying for a Loan Modification through Bank Of America ( BAC Home Loans Serviceing ) the Bank Actually confirm they received all the paper work! We were Instructed by Bank Of America Not to pay for the Month of March 2010 our 3 payments start in April, May, June 2010. After 3 timely payments we were told that we would be permently enrolled in the Modification. It even states that on their own websit. However thats not what happened. You see even though it took us 2 years to apply & finally get a temporary loan modification untill 3 timely payments during the waiting game that the Bank does ( Intentally) I believe the Bank is waiting for a reason to say hay you guys dont qualify thats what append to us she lost her job so insteas of the Bank helping us they urt us by telling us Lies reason # 1 why we did not qualify ( we paid our Trial loan modification late. Lie # 1 from the Bank I proved them wrong by our BANK OF AMERICA CHECKING ACCOUNT SHOW TIMELY PAYMENTS. Lie # 2 we simply did not qualify ( WE MET EVERY CRITERIA SET FORTH IN HAMP DEPARTMENT. ) This is the 3rd Lie & the one they ( BAC HOME LOANS has been saying to my wife & I ) EXCESSIVE FOREBEARENCE... Its no isolated incident that this is a schem to make more money for the Banks ( WHERE IS OUR GOVERMENT STANDING BY ALL THIS ) IT WOULD TAKE THE US GOVERMENT 99 YEARS TO FIGURE OUT OR DO ANYTHING WE WILL BE DEAD BY THEN... pod account problems acquiring funds
Organic apex will make you pay for "marketing fee" for nothing... Our company's name has never been at the top of the search results pages on any search engine! Organicapex.com sales person is terrible on the phone. They said they could get our website in the first page and push back the untrue complaint one of our exemployee made but I can't see any work done. When we tried to cancel our services with organicapex and get our money back but it seems that is impossible as we can't reach anyone from that firm!
very very poor customer service
Three weeks ago I deposited my husband's paycheck and Bank of America put a hold on 673.00 until January 29th. Since automatic payments have come out and they are charging me 35.00 per fee, until this date they will have used up most of the money that is on hold in fees. Mark is the branch manager and I explained my situation, he told me to come back next week after more fees had been charged and he will credit them, I did and he acted like he knew nothing of the situation. Very Very poor customer service.

suspected fraud
tue, oct 4th i, wolfgang esch went to this westchester, LA branch location to withdraw $300. at the ATM located inside the bank. Approximately 15 schoolage teenagers followed me inside the ATM lobby and started to make an alarming amount of incoherent earshattering noises. both ATMs were occupied by individuals that appeared to have problem finishing their transactions perhaps also starteled by said earsplittingly loud teenagers. therefore i went to the teller to get my money there. At this point the noise had ceased. The teenagers had left by the time i made it to the teller, ( Brenda Zavala ). Curiously though Brenda Zavala now developed a problem with her Bank computer to the effect of asking me repeatedly (total of eight {8} times) to enter my pincode. I complied but later became worried since Im overdue to recieve an insurance check in a significant amount. can you check this out, please. At the end of April 2011, I applied for a mortgage refinance through Bank of America to drop my interest rate from 6.75% to 4.75%. My closing took place on June 30. Prior to my closing, I was not given a copy of my HUD to look over the final numbers. Also, no one explained the numbers on the HUD to me; not Melvin Crawley (my loan processor), nor Christine Mason (the lady who put the HUD together), nor the attorney who was present at the closing.
The night of the closing, I noticed that two mistakes were made on the HUD: 1) I was charged $3503.40 for transfer taxes when I was promised a CEMA loan with no transfer taxes. 2) I was charged $1963.20 for the 4.75% interest rate, when I was only supposed to be charged $1210.93. (I was supposed to be charged for .625 points, but I was mistakenly charged for 1 point.)
Despite the mistakes, the attorney at closing persuaded me to sign the papers for two reasons: 1) He told me to call Bank of America the next morning. He confided that Bank of America waives transfer taxes all the time. They would not want to risk losing my loan. He also told me that just that morning, the attorney attended a closing in which Bank of America waived all of the closing costs. 2) I would have three business days to file a right of rescission, so there would be no risk.
Against my better judgment, I signed the papers as the attorney advised. I called Bank of America the next morning and spoke to Yoshi Hoover (the loan officer I have been working with since April). Mr. Hoover understood the mistakes that were made and that I should have received a CEMA loan. He was going to try and contact a manager to get my loan taken “one step back”. (It was the Friday of the July 4th weekend, and I guess managers were few + far between.) He also told me that if I did not hear back from him by Tuesday July 5, to definitely file the rescission papers.
But I did hear back from Mr. Hoover a couple of hours later. He said that Melvin Crawley’s manager Missy Ryan was on vacation, but he was able to get in touch with covering manager Jason Walters, and he was successful in getting my loan taken “one step back“. According to Mr. Walters, the closing papers would be “shredded” and it would be “as if the closing never happened”. Mr. Hoover has proof of this conversation.
I asked Mr. Hoover if I should still file the rescission papers anyway, but he told me no. If I file the rescission papers, he said, it would void the entire loan, including all the work that was done over the past two months leading to the closing, and we would have to start over again at square one.
Throughout the month of July, Mr. Hoover and Mr. Crawley continued to work on getting me the CEMA loan. I received a refund for the check that I had written out on the night of the closing. Bank of America was having trouble locating my original note, so on July 27, Mr. Crawley called me and offered to waive $1000 of my transfer taxes if I were willing to move forward with my loan without proceeding as a CEMA. I politely declined because I wanted the CEMA loan that I was promised.
Two days later, on July 29, my loan was funded. I don’t know how that happened as I was assured by Mr. Walters that my closing papers were to be “shredded” and it was to be “as if my closing never happened”.
To this day, I have been unable to obtain any kind of recompense from Bank of America. Missy Ryan (Melvin Crawley’s manager) has been less than helpful, stating that a mistake was made, I should not have been told what I was told, and they cannot ignore signed documents. Jason Walters has not returned my e-mails. I have also left a couple of voicemails for Norman Brooks (Missy Ryan’s supervisor), but he has not returned my phone calls either.
I feel as if I have been defrauded by Bank of America.

As someone who has the misfortune of working closely with bank of america on mortgage modifications and repurchases, I can attest to the fact that bank of america, via the countrywide division, perpetually demonstrates the highest degree of incompetence, gross mismanagement, and institutional corruption. Their modos operandum is to bully, intimidate and muscle others to comply with their improper and unethical demands. The same pond ### that perpetuated mortgage fraud on a massive scale with countrywide home loans are still infesting the organization. Unfortunately, they are now focused on whitewashing their past sins and off-loading the consequence to others. The public will continue to be victimized by the deceitful and dark behavior of this company unless the regulators and/or lawsuits dismantle this company.

mortgage mishandling of payment
I mailed my payment to BOA through my bank's online bill pay system. I mailed a payment of $347.10, but my payment due was $374.10. BOA held my check for two weeks, without contacting me to notify me that the payment was wrong (by $27). Two and half weeks later I received a check in the mail from BOA, for the payment I had mailed, with no explanation. I called BOA and was told they had a new policy of accepting NOTHING but the full amount. When I asked why I had not be notified of this policy, nor the fact that the payment was incorrect, the customer service representative was unable to provide an answer. Today, 10/08/2011 I received a notice of intent to forclose on my home!
How complaint can be satisfactorily addressed
I want the late fee refunded, and I want extra time to make the payment from September, so that I can pay this month and last month in two payments rather than one lump sum. BOA says they will ONLY accept payment in full on the account or they will forclose. Payment due is $766.91. I would like to pay $374.10 10/14/11 and the remaining $374.10 10/21/2011.

To whom have mortgage loan with bank of america, I borrow money on my home with cash out back 7/2004 amount of $120, 000 and the interest rate is 6.4% my payment is $890.16 each month I pay home owner ins. And the property tax my self. You was think out of the $890.16 some should go to interest and some would go to principal, since I have this loan for 7 years now, the whole amount to to interest nothing go to principal every month, I call them, I email them, I fax them, and now their just playing game with me. If every month I did not making a additional principal payment beside the $890.16 my balance is not moving, how can I pay this 20 years loan of if all of my payment is going to the interest ? I sit on the phone from 8 am to 5pmwith them each and every month with them every time I making the payment, they keep putting me on hold, and transfer to 10 difference person by the time their done with me, my head hurt so bad, my stomach is in knot, no energy left, and no matter resole, and it happen each and every month. I was think that I got the convention loan, their told me yes you have conventional loan but it simple interest, and the interest come in on the rear, I even pay them 4 months ahead, and still making payment every month never miss the payment. Paid Balance to zero on 5/13/08 and allowed payment to clear; closed account afterwards via phone and got a letter stating account was closed. On June 3, 2008 -- FIA CARDSERVICES did an autopayment on a closed account with a zero balance. The rep told me they could send me in check in a few days. She said it was my fault because I didn't go into the CLOSED ACCOUNT online and undo the AUTOPAY. I asked if AUTOPAY was another company, she said no. I asked then why couldn't one call close one account and all that is on it? She said it all depends... and went on and on with a litany of possibilities -- AND NONE OF THOSE POSSIBILITIES included "reversing the erroneous payment." I have to wait and get my money in check form though they got theirs in immediate electronic form. My bank had me to fax a form from their site and they reversed the charge and put the money back into my account. But that leaves next month. Oh yes, 60 days after closing the account the autopay will take my money. THAT'S STEALING!
CITI BANK did the exact same thing but they didn't bother to tell me about canceling autopay separately. The check took seven days to get to me. I am disabled, on limited income and was about to buy groceries when I thought to check my balance. I AM LAUNCHING A NATIONAL CAMPAIGN TO HAVE THE AUTOPAY STOPPED WHEN THE ACCOUNT IS CLOSED, especially if the balance is ZERO.

Bank of America runs a scandalous business based on fraud, theft, and greed. Yesterday I checked my account being that payday is literally around the corner. Shock, awe, and surprise do not even begin to describe what I felt when I saw my account was overdrawn by $219.95. On April 30, my paycheck was directly deposited into my account. So far, it's all copacetic. On May 1, I make 2 purchases and a withdrawal. One of my purchases came with a $35 overdraft fee. On the same day I paid 3 bills online. Now I am aware of how this works. The payments don't always go through at the time you make them so I did what everyone does... leave the money alone. On May 2, all my payments went through along with a $35 overdraft fee on each. How do I go from having $400 in the bank to being overdrawn by $219.95? The bills I paid only amounted to around $200. So let's do the math.
Yesterday after work I went into a Bank of America Branch. I spoke to someone who obviously did not know what she was talking about. I was told that it is Bank of America's new policy to charge overdraft fees on pending transactions. So even though at the ATM the receipt stated that I had funds available, B of A still hadn't processed my direct deposit. All of this makes no kind of sense to me. How come I was able to withdraw $40 from the ATM if there were no funds available? How was I able to get gas if there were no funds available? How was I able to get my morning coffee and bagel if there were no funds available? By the way, I was charged a $35 overdraft fee on a $3.54 purchase at Safeway.
I am a poor, single working mom trying to keep a roof over my family's head and food on the table. How do you explain to a seven year old you're sorry but those new shoes they need just aren't going to happen or that the fridge is empty because B of A took literally half my paycheck in overdraft fees? To say that I am angry, furious, livid, again, is an understatement. Bank of America took food out of my child's mouth and I am enraged. Today I am going back to the bank and speak to the Branch Manager and let them know that they stole my money and they will be putting it back into my account immediately and I will be using every outlet to let the public know what they have done. If I had done this to someone, I would be behind bars.
Yesterday, Jul 23, 2008, I tried to open a CD account with Bank of America online, and in addition to all the standard information (name, age, SSN, address, mother's maiden name, citizenship, routing number and account number) I was also asked to provide my user ID and password to the -another - bank account from which the CD would be funded. Stunned, I called their 800 number and they confirmed that, since I was not an existing customer with Bank of America, I had to provide the user name and password to my account at the other bank, or else could not open the CD.
I strongly believe this kind of information should have been disclosed first-hand, to avoid me entering all my credentials in vain. And what happens now to all my personal information, since I don't even have an account with them, so Bank of America cannot be held responsible for leaking it out?
This morning I went in person to their local branch, and the manager was as surprised as I was to hear that I was asked the user ID and password to access my banking account at another bank. My going in person to the local branch didn't solve the problem though, since apparently they, the local branch), have no communication with the online banking department, other than calling the same 800 number I had called the previous day. According to the local branch manager I talked to, they don't even share the same database!
Needless to say, I would never open an account with Bank of America, if it means to give away my user name AND password to my account at another bank!
Piracy is the word best used to describe how we have been traeted by Bank of america. We have a credit card with 9% apr. We have never had a missed payment or have been late. After looking at this months statement the APR went up to an astonishing 21%. We called right away and here was their reply. In sept there was supposed to be a notice that if you continued to use the card the APR would go up. They must have put it in micro print because We never saw it. They also stated that their cost of business was going up.
Now we feel we are a victim of cooperate piracy. Our other cards are below 10%. So spread the word.

In September (2008) My husband and I were forced to take out another credit card to pay for our 1 month old sons funeral. He passed away from a horrible and painful disorder called CDH, he never even got to come home. Well because of him being in the Nicu my husband used FMLA to be with him as much as he could. We did not get paid for half of August and half of September. We then had to use the card to pay some bills, since we had no income for a whole month. We THOUGHT the card was no interest for a year, Thats what we applied for when they sent us the offer, but they gave us a different one instead I guess. Well we were close to the limit and the lovely finance charge came, and that put us over the limit and a fee was assessed. I called the company and got a real nice lady and she explained to me how to not let it happen again, I just had to make a payment of $100 within a week. I made $125, that way we would be ok. Well I logged onto my account and saw yet another over limit fee, for no reason, I was nowhere near over limit. So I called and got some ### (supposed Manager) and he told me that when your card goes over you have 20 days to fix it, I called on the 21 day. You see if you dont fix it in 20 days they charge you again. Well when I called the first time they did not tell me this. Had I not made that extra $25 on my payment we would be in a downward spiral of over limit fees. The 2nd "customer service" (I use that term lightly) agent could care less and said that they already gave me back one of the fees so they will not do it again, even when it is their fault for not telling me all of this info. If they would have given us the card they offered, the one we signed up for this never would have happened. I have a few credit cards and thought HSBC was horrible, think again, at least they work with you a little bit (besides that credit protection they keep "forgetting" to take off, but don't forget to charge us for) We have great credit but I am willing to hurt it a little by canceling my account with them. Horrible, Horrible customer service, if you can even call it that.
I would be curios to hear further response's to BOA's continued efforts to defraud customers in unfair marketing practices.
With reference to multi-state marketing offers encouraging new retail clients to transfer there business to BOA, it is amazing the verbiage on the 'net re BOA giving the customer the run around. The scenario: a $50 to $100 offer to open a checking/savings account etc, where BOA will make a deposit within 90 days of opening (naturally, if the client's account are in good standing).
From their, the client will start to wonder where his small "gift" is after it does not appear within 90 days. The banking centre will insist that it is coming in through US mail, just be patient. The customer call centre, while very helpful, will admit to not having any record of the offer associated with this particular account. The CS team online will note that if the personal banker (an oxymoron at BOA) did not enter the code at time of signup, the client is ineligible. Gee, that is one questions that I forgot to ask.
Who am I? Just another burned BOA customer going back to Dimon's empire. Just another customer with an 790 FICO, two mortgages (that could have gone to BOA), etc, who will now spurn those colors to all friends, business network et al, all 'cause of a lousy $50. The principle is what counts here.

I'm writing you because you represent my voice and that of my fellow Americans in government when we feel we are being wronged. At this time, Americans are struggling mightily to make ends meet. Your efforts to fix predatory lending practices (especially in sub prime lending) have been noticed and appreciated. To that end, I feel that another predatory practice by Bank of America needs to be discussed in a public forum and addressed soon thereafter. B of A currently charges fees of $35 per charge when one tries to charge more than one has in his or her bank account. At face value, it may seem that this is a fair practice. I can understand the practice if someone is passing bad checks and a fee has to be assessed. But with today's debit technology, an automatic decline should be easy and free to the public. When one digs deeper, one realizes that this is a practice purely designed to unfairly gouge the American public through deceit and obfuscation. So, here's the policy…A $35 fee for each time a charge over your funds is ATTEMPTED. As an example, recently I unknowingly was making charges on my debit card when I didn't have the money to cover it. The charges were numerous but only totaled $23. That's $23. One charge was for $.27 cents…for which I was charged $35. B of A charged me over $400.00 in overdraft fees for that $23 overage. I called Bank of America to try to find some relief for these charges and was told no. Seems counter to the "flexibility" and understanding for families that the new administration is trying to get in return for billions in bailout dollars. Look a little deeper and the practice is even more disturbing: 1. You can't actually just get an option for a decline on your charge without the $35 fee. So, even if you don't have overdraft coverage, you will still be charged $35. Since technology has allowed banks to simply decline a charge, I don't understand how BofA can justify charging a $35 fee for each charge versus just declining it for FREE. 2. BofA says the only way to protect against this is to link a BofA credit card or a savings account to your overdraft checking. So, an over-limit charge is charged to your BofA card or deducted from you savings account. In both cases, BofA makes money….either through interest on your credit card or from service fees on the savings account that you are required to have. And, by the way, the overdraft service also has another fee associated with it. 3. As if that weren't enough, BofA recently increased the allowable number of charges per day from 5 to 8. That a $105.00 per day increase, per cardholder. The bottom line is that I don't want my money back from BofA (though they should have at least treated me better considering I hold six accounts with them). I, like the many Americans flooding blogs with similar stories, want justice. I would like this issue explored fully and for Bank of America to be called to answer for this unfair practice. The fact that American taxpayers in the US now own a $50B TARP stake in BofA (which only has a market cap of $40B, by the way), only makes our voices that much more relevant in this matter. Lastly, I will say that I firmly support Obama's call for Americans to be more responsible with their money. I was less than responsible for letting my account go overdrawn by $23. Thankfully, my wife and I make decent money and can cover this amount. Just think how American's with lesser incomes would struggle with this. Then realize that this a core profit center for BofA.
Since Jan of this year Bank of America took out hunderds of my money out of my checking account to pay for things on the web that I never did and so my rent check came back nsf and my last 2 paychecks where put in my checking account again think I took care of the problem will boy was I wrong and so I put my last paycheck in my saving account because I was told checking can not touch it so I went to the back to take my money out so I can pay my rent and start paying back rent and they took all of my money out of my saving and put it all in my checking and I could not touch it. I had no money to live on till my next pay day which I get paid once a month and now I'm being kicked out of my apartment with no where to go and no food and I still have to go to work. Thanks to Bank of America I'm now going to be homeless I'm just waiting for the police to come over and kick me out and do a pock out on my apartment. Do not trust Bank of America they will rip you off and leave you pennyless and homeless.
